Read and accept this policy before using, saving, exporting, or sharing anything produced by this tool.
1. Scope and local execution
This tool is intended only for employees holding a Málaga Center employment contract. It runs strictly in this browser on this computer. It does not automatically save, transmit, share, or send data anywhere. Data is saved or shared only if the user manually chooses to save it locally, export a file, or send a file outside the tool. When the browser tab is closed, any unsaved information is erased.
2. Publisher and contact
This tool is published by the Málaga Workers Council (Comité de Empresa) in collaboration with UGT, as part of their lawful representation and information activity. Contact details are on the Contact page. The publisher does not act as a data controller under Articles 4 and 24 GDPR for the data users process locally, because that data never reaches the publisher.
3. Not Oracle, not HR, not payroll
This tool is not created, approved, hosted, maintained, monitored, endorsed, or operated by Oracle. It is not connected to Oracle HCM, payroll, finance, HR, Slack, email, SSO, analytics, cloud storage, or any company infrastructure. The Oracle name is referred to only descriptively to identify the employment context; no affiliation is implied.
4. Purpose: individual transparency and worker support
The sole purpose is to help an individual employee understand their own Málaga Center salary insights using information they personally choose to paste or enter. It is a private, informational support tool in the context of worker representation, consultation, and the lawful employee information activity protected by Articles 64 and 65 of the Workers' Statute and Article 28 of the Spanish Constitution.
5. The user is the controller of their own data
Within the meaning of Article 4(7) GDPR, the user is the sole controller of any personal data they enter. The publisher does not receive, observe, store, or process that data. The user must have a lawful basis to access the data they enter and must not enter personal data of other identifiable employees without a lawful basis under Article 6 GDPR.
6. Data minimisation
In line with Article 5(1)(c) GDPR, users should paste only the Compensation History table needed for the calculation. Do not add national ID (DNI/NIE) numbers, bank details, home addresses, health data, family data, manager comments, disciplinary information, or data about other identifiable people.
7. Encrypted local files
If the user manually chooses to save an encrypted file, encryption happens locally using AES-GCM-256 with a key derived from the user's password (PBKDF2-SHA-256). The password is not stored, transmitted, or recoverable by the tool. Losing the password means the file cannot be opened. The user is responsible for safe storage of the file and password.
8. Confidentiality and duty of secrecy
Salary, compensation, career level, and compensation history are personal and confidential under Article 18 of the Spanish Constitution and Article 4.2.e of the Workers' Statute. Council members and union representatives are additionally bound by the duty of professional secrecy (deber de sigilo) under Article 65.2 of the Workers' Statute and Article 8 of Organic Law 11/1985. Use the tool only on a private or trusted device.
9. No collection by the publisher
Using this tool does not submit data to the Málaga Workers Council, UGT, Oracle, or any third party. The publisher cannot see what the user enters. Data leaves the user's computer only if the user manually exports, saves, uploads, forwards, or sends it outside the tool.
10. No automated decision-making
In accordance with Article 22 GDPR, the tool does not produce decisions with legal or similarly significant effects. All outputs are informational estimates for the user to review. No profiling is performed and no data is transferred to any third party for automated processing.
11. No responsibility for user misuse
The publisher is not responsible for a user's decision to paste, alter, save, export, publish, forward, disclose, or store their own or anyone else's data. Users must comply with their own confidentiality, data-protection, employment, security, intellectual-property and trade-secret obligations (including Ley 1/2019 where applicable).
12. Informational estimates only
Calculations are estimates based on the fixed Málaga level policy, the past Oracle RIF/ERE conditions, and the data entered by the user. They are not payslips, payroll records, HR confirmations, legal opinions, contractual promises, or evidence that any amount is owed. The applicable Convenio Colectivo edition in the BOE and official HR documents are the authoritative sources for any binding figure.
13. Accuracy depends on the user
The user is responsible for checking imported rows, dates, levels, job titles, salary, compensation, and results. If any number matters for a claim, consultation, grievance, negotiation, disciplinary case, or legal process, verify it against official documents (payslips, contract, Convenio Colectivo) and seek appropriate professional advice.
14. Spanish and EU legal context
This policy is designed around Article 5 GDPR principles, Spanish Organic Law 3/2018 (LOPDGDD), Articles 4.2.e, 64 and 65 of the Workers' Statute (RDL 2/2015), Organic Law 11/1985 on Freedom of Association, Articles 18 and 28 of the Spanish Constitution, and the sector Convenio Colectivo under which Málaga Center contracts are framed. The tool is intended to reduce risk by being local, voluntary, transparent, limited-purpose, and data-minimised.
15. Right to lodge a complaint
Users may exercise their rights of access, rectification, erasure, restriction, portability and objection (Articles 15–22 GDPR) with the relevant data controller, and may lodge a complaint with the AEPD (www.aepd.es) under Article 77 GDPR. Because this tool does not collect data, such requests should be directed to the actual controller of the data in question (e.g. Oracle for HCM data).
16. No waiver of rights
Nothing in this tool waives any employee, trade-union, Workers' Council, data-protection, labour, collective, or constitutional right. Nothing here authorises unlawful disclosure of personal data, trade secrets, confidential documents, or third-party information. Acceptance does not constitute a contract between the user and the publisher.
